Kazakhstan GOST-K Certificate of Conformity

CoC is the documentary evidence required by Kazakhstan law, which testifies that the product forwhich such documents are issued conforms to legal requirements, approved design codes and manufacturing requirements specified in Kazakhstan standards. It is mandatory for hazardous equipment and materials to have a Certificate of Conformity to meet the requirements of the customs authorities and to facilitate customs clearance. In some cases a CoC has other certificates as mandatory attachments, e.g. Hygiene Certificate,Certificate of Fire Safety.

Within Kazakhstan national certification system GOST-K is the supreme authority responsible for accreditation of certifying agencies. There are several agencies, which must have GOST-K licenses, authorized to issue certificates. The official list of such agencies is available from GOST-K.

Certification by GOST-K and/or authorized agencies is necessary in all cases identified in Kazakhstan authorities lists (see Paragraph 9.1).

Even if equipment has been brought into and certified in Kazakhstan in the past, it is necessary to go through the same certification procedure again if it is imported under a new contract.

An Equipment Technical Passport, however, is required prior to installation, commissioning and operation. It is a document dossier, the purpose of which is to satisfy GGTN or other appointed installation and commissioning authorities that the item conforms to the specification and is fit for its intended purpose. In the current Kazakhstan Regulatory system, the Technical Passport acts as an ongoing maintenance record for the life of the equipment.

GGTN证书,GosGorTechNadsor, GKChS of Committee of State control on Emergency

Situations, State Mining and Industrial Supervision Department

This Regulatory Authority is a subdivision of the Emergency Response Agency of RoK. GGTN is responsible for the safety and structural integrity of the Industrial (mechanical) equipment.

GGTN Permit to Use is required for potentially hazardous equipment or systems.

GGTN review is required prior obtaining the Permit to construct from the Committee for Construction.

GGTN issues Permit to Manufacture, Test and Use of (including foreign) technologies, technical devices and materials used at Hazardous Facilities.

GGTN acts as the main Authority during the process of signing of the Integrated Test Act. This act is endorsed by the representative of the local branch of GGTN, that’s why it is important to inform this subdivision of GGTN of the project execution status on continuous basis. GGTN inspector has to visit Construction Site prior to the start-up and commissioning phase in order to ensure that approved technology was followed.

Local branch of GGTN gives recommendations on all applications for Land Allocation (they are a member of the Committee for Land Allocation).

A GGTN Permit to Use of “Hazardous Equipment” is also required. The purpose of the Permit is to confirm that potentially hazardous equipment, technical devise, materials or systems including equipment of foreign manufacture meet industrial Safety Standards and is safe to operate. Normally GGTN will review a system rather than individual equipment items, i.e. Oil / gas Separation Systems, Oil Export Systems etc. Generally the term “Hazardous” applies to the following:

· Cranes or any Lifting Equipment with a Safe Working Load greater than 10 Tones

· Boilers

· Pressure Vessels

· Major Rotating Equipment (Compressors, Pumps, etc.)

To agree GGTN’s requirements for Permits, an Equipment List shall be submitted for review and marked up by GGTN. Generally the information required is that provided with the Technical Passports plus the following:

· Manufacturer Company Profile

· Manufacturing certification accreditation (ISO 9000, API Q1, etc.)

· Customer List

· Certificate of Origin

· Details of Training

Kazakhstan  Also called Metrological Certificate

Also called Metrological Certificate, Pattern Approval Certificate for Measuring Instrument, is a special variant of the GOST-K certificate and concerns mostly the operating security of measuring equipment issued by State Committee for Technical Regulation and Metrology of the Ministry of Industry and New Technologies of RoK. The certificate can refer to specific equipment or a type of equipment.

Kazakhstan Hygiene Certificate

Some goods and products may require a Hygiene Certificate as well a CoC. In the petrochemical industry, these can include various chemicals and uniforms that have direct contact with human skin.

Hygiene certificates are issued by SES which is a subdivision of the Healthcare Agency of RoK responsible for activities related to the sanitary regulations and labor protection. Certificates are issued at the Federal or the Regional level.

For chemicals considered hazardous, a material safety data sheet and Hygiene Certificate in Russian and English languages must accompany each chemical. These documents are used for chemical classification. RoK government officials may demand other licenses or certificates e.g. some specific chemical substances require an import license. A Hygiene Certificate for hazardous chemicals can only be issued by the Federal authorities. Vendor should consult relevant authorities through its Agency. (See Paragraph 9.1)

Hygiene certificates are issued for a specific time period depending on the type of chemicals. Some products must be re-certified after one or more years. Some radioactive substances must be certified for conformity to a safety range as identified by RoK

laws.

Hygiene Certificate

Kazakhstan  Certificate of Fire Safety

The Certificate of Fire Safety is mandatory for some materials and equipment. In these cases it forms an integral part of the CoC.

The purpose of this certificate is to confirm the compliance of the product with legislative fire and safety requirements and to ensure that the product is safe for life, health, property and the environment.

SFSD will determine if Certificate of Fire Safety is required. Project endorsement by SFSD is required prior to obtaining the Permit to Construct from the Committee for Construction. A list of products, which require Certificate of Fire Safety, is available from the State Fire Department

Kazakhstan  Technical Passport

Passport is a term, used for a set of documents formatted and collated in accordance with Kazakhstan requirements in respect of nameplate data, mechanical characteristics, composition of materials of construction, test procedures, test results, reports, etc. Relevant Certificates of Conformity along with secondary certificates of Hygiene and/or Fire Safety are also required in the Passport. The Passports must be produced in the required format.

The following is typical of the contents required in a Passport - though it is mandatory to adhere to the format and required content of the official Passport form:

· Name plate information and data

· Environmental conditions in which equipment is designed to be used

· Basic specification of equipment

· Performance criteria

· Specification of assemblies and parts contained in the equipment/package

· Test Certificates and Test Reports (Factory Acceptance Test results, Type Test details, etc).

· Documentation & Drawings including Instruction Manuals

· Information/data on the location where equipment is to be installed

· Certificates of Conformity and other conformance certificates

· Data to be added to the Passport at site

· Details of personnel who are appointed to use the equipment

· Record of technical reviews/surveys for the site (on-going activity)

· Registration Certificate (to be issued by GGTN on site)

A single Passport for a package containing several items can only be accepted if the package has been tested as an integrated unit and the test results and documentation is available to support this.

The Passport shall list each item of the package and its associated data. Examples are separators,

metering skids, cranes, etc.

Equipment Technical Passport is required prior to installation, commissioning and operation.

 Kazakhstan Explosion-Proof Certificate

Technical devices, including foreign-manufactured, used in hazardous production facilities should be certified to prove their conformity to the industrial safety requirements set by RoK law. The list of technical devices used in hazardous production facilities and subject to certification is elaborated and approved according to the procedure established by the Government of RoK. To obtain a certificate like that, a company applying for the certificate must submit samples of products to be certified, manufacturer details and technical documentation needed to carry laboratory testing. Verification stages - verification carried out at the testing laboratory to verify whether the design and performance of the electrical equipment comply with the applicable requirements with respect to human and environmental safety. A certification body (accredited within the GOST-K system) decides whether to issue a certificate or refuse to issue a certificate on the basis of test reports, expert examination of technical documentation, applicant`s details. All explosion proof electrical equipment is subject to mandatory certification within the GOST-K certification system, because it falls within the category of dangerous equipment. Examples of the explosion proof equipment: power generation equipment, power distribution equipment, power transmission equipment, power measuring equipment, power control equipment, power conversion equipment, power storage and consuming equipment, telecommunications equipment, devices to be used in hazardous areas, etc. Ex-equipment, including Ex-components of the equipment listed in the "Nomenclature of Products (works) and services requiring mandatory certification under the laws of the Russian Federation", is subject to certification.

 Kazakhstan  Letter of Refusal

A refusal letter is an official document issued by a certification authority which states that no mandatory certification is required for the product or that the product belongs to a group of products for which compliance can be confirmed with a compliance declaration. A refusal letter must be written on the letterhead of the authority that issues it and must bear the coat of arms seal of said authority.

A refusal letter may be required when it is not clear which commodity code shall be used for the identification of a specific product, which naturally raises the question of whether or not the product needs to be certified. This question may be asked by different supervisory authorities such as the customs or other supervisory agencies and sometimes your clients may also request that you provide a compliance or quality certificate for the products you offer them. However, a refusal letter cannot serve as proof of the product’s quality; therefore in the majority of cases it’s best to get a voluntary certificate.

It follows from the above that there can be to kinds of refusal letters:

· Letters for the customs authorities

· Letters for business partners

The only difference between these two types is the addressee.

A letter for a business partner is addressed to the sole trader or business organization that requested it.

A letter for the customs authorities is addressed to the head of the state customs committee plus it also includes information about the contract under which the products were imported, there are no other differences.
